USER ACCOUNTS AND REGISTRATION
You are not required to create a user account or provide any personal information in order to visit the CalendarTree Website.
You may be required to create a user account, however, to receive literature or communications or to take advantage of some of our services, such as creating schedules, sharing schedules, and saving schedules to calendars. You must also register if we offer, and if you choose to enter, any surveys, contests or other promotions. During registration, you may be asked to provide certain categories of personally identifiable information, such as your name, address, and email address.
If another CalendarTree user shares a schedule with you or includes your personally identifiable information in a schedule, we will collect that information even if you have not registered and created a user account. In addition, once you have registered for a user account, you will be authorized to create and share schedules using the CalendarTree Technologies. If you create a schedule, we will collect the email addresses of the individuals that you share that schedule with, regardless of whether or not such individuals are CalendarTree users. We will also collect any other information that you or other users include in the schedule.
The information which you supply to CalendarTree enables us to customize and enhance the service we provide to you. In addition, it helps us communicate with you about CalendarTree news, events, promotions and new products if you wish to receive such information.
PASSIVE COLLECTION OF INFORMATION
In addition to the information that you provide to us when you register for a user account, CalendarTree collects information about how you interact with our Website. The types of passive information we collect includes your IP address, which type of browser you are using, where you go on the Website and other information related to your Website use and traffic patterns. CalendarTree also collects information about your use of the CalendarTree Technologies, such as selection of objects or configuration changes within the Software. This passive information does not identify you to CalendarTree by name, and CalendarTree does not link your IP address to your personally identifiable information. CalendarTree compiles aggregated data by combining information from many users, without including any information that could be used to identify you or anyone else by name.
In addition to the methods described above, we may also collect information using cookies, web beacons or other technologies. Cookies are small files placed on your hard drive that assist us in providing customized services; for example, the use of cookies allows us to reduce the frequency with which you will need to enter your password on password-protected areas of the Website. Additionally, in some cases, certain functionalities are only feasible through the use of a cookie. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the Website, you may be required to enter your password more frequently during a session, and you may be unable to install or use certain CalendarTree Technologies. Cookies and other technologies make our Website and CalendarTree Technologies easier to use and help us customize and personalize the Website and CalendarTree Technologies based on your interests and activities.
COLLECTION OF INFORMATION FROM CHILDREN
We comply with the Children's Online Privacy Protection Act, which requires us to notify and obtain consent from a parent or guardian before we collect, use and disclose the personal information of anyone under 13 years of age. The CalendarTree Technologies are not directed to persons under 13 and we do not knowingly collect personal information from children under 13. If you become aware that your child has provided us with personal information without your consent, please contact us at privacy@CalendarTree.com. If we learn that we have inadvertently collected personal information from children under 13, we will promptly delete it.
USE OF INFORMATION
CalendarTree uses the information you provide to operate and improve the CalendarTree Technologies, and to deliver the products and services we offer. We may use your contact information to respond to your inquiries, to provide customer support and to supply any products or services you have requested. We may also use the information you provide to create, share and save schedules, to customize and enhance the service we provide to you, to communicate with you about CalendarTree news, events, promotions and new products, and to deliver advertisements and information to you, including targeted advertisements that are relevant to your CalendarTree activities and schedule. You may also opt in to receive communications from other businesses that use CalendarTree to market and sell their products and services. If you choose to receive email messages related to the products or services available through the use of the CalendarTree Technologies, the information you provide will be used for those purposes. If you order literature or request information through the use of the CalendarTree Technologies, you may be contacted by us or by a third party to follow up on your request. CalendarTree strives to provide useful information about its products and services to its customers, and we may also contact you for other reasons if you are a customer or create a user account. We will not, however, use the information you provide to contact you unless you request to participate in such programs or provide consent to be contacted.
Through the CalendarTree Technologies, you can create and share schedules with other CalendarTree users and individuals that are not CalendarTree users. To the extent you provide the e-mail address of an individual that is not a CalendarTree user for purposes of providing a schedule you created, we will automatically send such individual the calendar you created and we will store such individual’s information for the purpose of sending such calendars. Such individuals may contact us at privacy@CalendarTree.com to request that we remove this information from our database.
Because we use the information we collect to measure and improve the CalendarTree Technologies, we may also contact you occasionally to obtain feedback from you through customer surveys, but you are not obligated to participate in such surveys if you do not wish to do so.
THIRD PARTY WEBSITES
CalendarTree participates in joint marketing and other service offerings with non-affiliated third parties. Our Website contains links to third-party sites, and third-parties may provide you with an opportunity to use the CalendarTree Technologies from or through their websites. For example, if you are shopping or reviewing product information on a third-party website, you may be redirected to the CalendarTree Website or provided with access to the CalendarTree Technologies. These third parties may also collect information from you in connection with your use of the CalendarTree Technologies or otherwise. For example, if you request product information or commence a purchase transaction in connection with your use of the CalendarTree Technologies, a third party may contact you or otherwise use your information in connection with such request or transaction.
Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you or we disclose your information to any third parties, including any third parties that provide you with access to the CalendarTree Technologies, different rules may apply to their use or disclosure of your information. This Privacy Policy does not apply to the practices of companies that we do not own or control, or to people that we do not employ or manage. Please check the privacy policy at each website you visit.
SHARING OF INFORMATION
If you request or consent to be contacted by a third party that is offering products or services in conjunction with CalendarTree, we will provide that third party with your personally identifiable and other information so that they can contact you. From time to time, we may also request your permission to provide third parties with your personally identifiable information for various purposes, including allowing such third parties to contact you about products and services in which you may be interested. If you consent to such disclosure, we may provide your personally identifiable and other information to such persons for such purposes. We will not, however, share your contact information with any third parties unless you ask us to do so or provide consent for the disclosure. CalendarTree also shares aggregated data and related usage information with third parties for marketing and advertising purposes in order to provide advertisements through the CalendarTree Technologies (including advertisements contained in emails to CalendarTree users) that better match your interests, but this aggregate information does not contain any personal information which can identify you or any other individual user. We do not control how third parties disclose or use the information we share with them.
The CalendarTree Technologies enable users to create and share schedules. If you sign up to receive a schedule that has been created by another user, the creator of such schedule will receive access to your email address. If you do not wish to share such personally identifiable information with other users, you should not sign up to receive schedules created by other users. You are solely responsible for all information which you share, save, submit, disseminate or otherwise communicate through the CalendarTree Technologies including, without limitation, any content that you disclose in the “notes” section of any schedule. You agree that all such content and other communications shall not be deemed to be private or secure, and that any such content and communications can be read by the operators and/or other agents of CalendarTree, whether or not they are the intended recipients.
CalendarTree may provide your information to our affiliates, each of which will abide by the terms and conditions of this Privacy Policy. We may also work with third parties that we refer to as internal service providers to facilitate or outsource one or more aspects of the products and services that we provide to you, and we may provide some of your personal information directly to these internal service providers. The internal service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide to them for any other purpose except to facilitate the specific outsourced operation, unless you have explicitly agreed or given your prior permission to them for additional uses. In some instances, the internal service provider may collect information directly from you. In these cases, you will be notified of the involvement of the internal service provider, and all additional information you provide them and their additional uses will be strictly up to you. If you provide additional information to an internal service provider directly, then their use of your personal information is governed by their applicable privacy policy.
In the event that we or certain of our assets are acquired, user information may be included among the transferred assets. If this does occur, your information will remain subject to the terms and conditions of our Privacy Policy.
While CalendarTree strives to protect the personal information of our users, CalendarTree will release personal information if required by law or in the good-faith belief that such action is necessary. Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect as a result of your use of the CalendarTree Technologies. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.
SECURITY
CalendarTree has agreements with third parties and other security measures in place to protect against the loss, misuse and/or unauthorized alteration of the information under our control or under the control of our service providers. Your personally identifiable information is protected by utilizing both online and offline security methods, including firewalls, passwords and restricted physical access to the places where your information is stored. Your user account information is kept on a secured server behind a firewall. Our staff is trained to comply with our security procedures, and our security procedures are regularly reviewed and revised, if necessary.
EMAIL OPT-OUT
If you have consented to our disclosure of your personally identifiable information as set forth above, but later wish to opt out and withdraw such consent, you may do so by contacting us at privacy@calendartree.com. However, if you wish to stop receiving communications from a third party to whom we provided your information prior to your withdrawal of consent, you must contact that third party directly, as we have no control over their communications or use of your information. Please take this into consideration before consenting to our disclosure of your information to such third parties.
If you have signed up to receive CalendarTree' commercial email and would like to avoid receiving such email in the future, you may opt-out of receiving it by sending an email to privacy@calendartree.com. CalendarTree will try to communicate with you only according to your instructions.
AMENDMENTS TO POLICY
Please note this Privacy Policy will change from time to time. All amended terms shall automatically be effective when they are initially posted on the website or included in the software. If we make any material changes to our Privacy Policy that affect user information already stored in our database, we will post a prominent notice on our Website notifying users that our Privacy Policy has changed. Our use of your information shall be governed by the terms and conditions of our Privacy Policy in effect at the time of such use.
